Alta Performance Materials Holdings (UK) Limited (incorporated in England and Wales with company number 11815817) (“ALTA”, “we” and “us”) is the operator of this website (accessible at altapm.com), including all of its web pages (the “Site”). ALTA operates the Site on behalf of the Alta Performance Materials group of companies (the “ALTA Group”). This privacy notice describes our processing of personal data, personally identifiable information and equivalent terms (referred to throughout this privacy notice as “personal data”) in connection with our operation of the Site and other business relationships. Personal data is sometimes also referred to as personal information, personally identifiable information, or other analagous terms that mean any information that directly or indirectly identifies you or is reasonably capable of being associated with you or, in certain jurisdictions, your household. ALTA is the controller of any personal data that we collect or you provide as a result of accessing or using the Site.

ALTA is committed to ensuring that your privacy is protected. What Personal Data We Process and For What Purposes

Personal Data that We Collect Automatically

When you access and use the Site, we may automatically collect, store and otherwise process certain technical information that constitutes personal data. This may include  your IP address, the time and duration of your access, links clicked while on the Site, any error reports run while on the Site, any external sites from which you visited the Site or which you visited after the Site, and information relating to your browser, operating system and device (including data about your hardware model, operating system and version, mobile network, firmware and versions, wireless carrier, mobile country code and network code, Internet Protocol address, network speed, unique device identifiers such as hardware identifier like MAC address, software identifier, chipset serial number, browser type, and app version). We process this personal data: (1) in order to comply with the ALTA Group’s legal obligations (for example, in relation to export controls and anti-bribery, terrorist financing, and money laundering requirements), and (2) in furtherance of our legitimate interests in order to make the Site available, to see where the Site is being used in the world to ensure coverage, and for click stream analysis to help better understand Site usage, to maintain the functionality and security of, and improve, the Site, ensure compliance with our Terms of Use, and in connection with corporate transactions (including sales, purchases and reorganizations) involving all or part of the ALTA Group.

If you fail to provide this personal data then you may not be able to access or use the Site as intended or at all.

Personal Data that You Provide

When you enquire about any product order, place a product order via the Site or otherwise interact with the ALTA Group via the Site (including in connection with the submission of any job applications or in relation to the purchase of supply of any products or services), you may provide personal data relevant to that (potential) order, business interaction or communication. This personal data may include your basic identifiers (such as your name and online and physical contact addresses), payment and other financial information, data relating to your compliance activities (for example, in order to satisfy the ALTA Group’s data privacy and anti-modern slavery policies), signatures, personal identification information, your work and other previous experience, information that you have made available on social media and other platforms, sensitive, criminal offence or special category personal data that we must collect in order to comply with applicable employment laws or that you otherwise provide, and compliance, export, customs and tax data. This includes, for example, personal data that we receive from affiliated companies within the ALTA Group if business relationships also exist with such affiliated companies.

We process this personal data as necessary for the ALTA Group: (1) to enter into or perform any relevant contract with you (or the persona or organization that you represent), (2) in order to comply with the ALTA Group’s legal obligations (for example, in relation to export controls and anti-bribery, terrorist financing, and money laundering requirements), (3) as necessary for the ALTA Group’s establishment, exercise or defence of legal claims, (4) in furtherance of our legitimate interest in operating the ALTA Group’s business (including to administer the ALTA Group’s business, to identify economic and other risks, in connection with corporate transactions (including sales, purchases and reorganizations) involving all or part of the ALTA Group), (5) where such personal data has been manifestly made public by you, and/or (6) where you provide solicited sensitive, criminal offence or special category personal data, with your explicit consent.

If you fail to provide this personal data then the ALTA Group may be unable to provide you with requested information, proceed with your job application, negotiate or enter into the relevant business relationship and/or the performance of any ongoing business relationship may be harmed.

Information We Derive

We may derive personal information or draw inferences about you based on the information we collect. For example, if you work for our business partners, we may use such information to better understand your interests in our products and services.

Profiling and Automated Decision-Making

We generally do not use automated decision-making (including profiling) within the meaning of Article 22 of the General Data Protection Regulation (EU) 2016/679). If we apply such processes in the future, we will inform data subjects separately in accordance with the applicable statutory provisions.

Digital Marketing

We may periodically send e-mails about other information which we think you may find interesting (based on the interactions you have had with us) using the e-mail address which you have provided. We will not distribute (other than as set out in this Privacy Notice), sell or lease your personal data to third parties unless we have your permission or are required by law to do so.

Security of Personal Data

We are committed to ensuring that your personal data is secure. In order to prevent unauthorised access or disclosure, we have put in place appropriate technical, operational, physical, electronic and managerial procedures to safeguard and secure the personal data we collect as part of the Site.

We also enter into agreements with service providers, contractors, and processors for processing of your information. These parties have their own security standards for personal information protection. In light of the evolving risk environment, particularly the risks of security incidents on the Internet, we encourage you to be vigilant with your personal information and exercise caution.

Sharing of Personal Data

Personal data is generally processed within the ALTA Group for internal administration purposes, and is therefore shared with and access is provided to other companies within the ALTA Group. Depending on the categories of personal data, only dedicated departments / organizational units may be granted access to your personal data.

We may also transfer or provide access to your personal data to recipients outside of the ALTA Group. Such external recipients may include: (1) service providers and sub-contractors of our service providers that (on the basis of  separate agreements with the ALTA Group or the direct service provider to the ALTA Group) provide certain services (e.g. in the areas of IT services, logistics, print services, collection, consulting or sales/marketing) including the processing of personal data; (2) our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interest, (3) third parties and their advisors in connection with corporate transactions (including sales, mergers, purchases and reorganizations) involving all or part of the ALTA Group; and (4) private or public bodies in connection with any legal or regulatory proceedings or investigations in which the ALTA Group is involved.

We may disclose anonymized, aggregated, or de-identified information that cannot reasonably be used to identify you. When doing so, we publicly commit to maintain and use the information in an anonymized, aggregated, or de-identified form and not attempt to re-identify the information, unless permitted or required by law.

Retention of Personal Data

We store personal data for as long as necessary to fulfil the purpose(s) for which it was collected or provided to us or, if longer, if there is a legal obligation to do so (e.g. to comply with statutory retention obligations). We delete personal data even without an action by the data subject as soon as further retention is no longer necessary for the purposes for which the personal data was collected or otherwise processed or if further retention is not permitted or required by law otherwise. In general, personal data collected in the course of the business relationship is retained at least until the end of the respective business relationship.

Cross-Border Transfers of Personal Data

ALTA is based in the United Kingdom and we host this Site, and process any personal data that you provide, in the UK. We may also host (including through the use of third parties) this Site on servers based in other jurisdictions. We may onward transfer or make such personal data available to other members of the ALTA Group or third parties based outside of the UK. If we onward transfer personal data to recipients in third countries, we will do so in accordance with applicable law. That may include the application of appropriate safeguards to ensure the necessary level of data protection at the recipient or in the recipient’s country. Appropriate safeguards may, in particular, consist of an adequacy decision in which the UK Government or European Commission has decided that the relevant country ensures an adequate level of protection. Your Rights

Depending on the jurisdiction in which you are based and the basis on which you have provided personal data to us, you may (as data subject) have certain rights in relation to our processing of your personal data. In particular, if the General Data Protection Regulation (EU) 2016/679) or such regulation as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018 applies to our processing of your personal data then you have the right to:

  1. confirm our processing and access the personal data we have collected about you, including the categories of personal data, the categories of sources from which the personal data is collected, the business or commercial purpose for collecting, selling, or sharing personal data, the categories of third parties to whom we disclose personal data, and the specific pieces of personal data we have collected about you. Where it is technically feasible or required, you may receive this data in a portable format;
  2. request the rectification of incorrect or to complete incomplete personal data;
  3. request the erasure of your personal data in certain circumstances;
  4. request the restriction of the processing of your personal data in certain circumstances;
  5. exercise the right to data portability in certain circumstances;
  6. object to the processing of your personal data in certain circumstances (i.e. where we are processing on the basis of our legitimate interest unless we demonstrate compelling legitimate grounds for the processing which overrides the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims); and
  7. where we rely on consent for the processing of your personal data, the right to withdraw your consent (although noting that in certain circumstances we will still be permitted to continue processing your personal data under applicable law).
